General Terms and Conditions for Candidates

1. Scope of Application

These General Terms and Conditions (“GTC”) govern the use of the TalentHub platform (“Platform”), operated by AeroSelect UG (haftungsbeschränkt), registered in Berlin, Germany (“AeroSelect”, “we”, “us”).

By registering for or using the Platform, you (“User”, “Candidate”, “you”) agree to be bound by these GTC in their entirety. These GTC apply exclusively; any conflicting or supplementary terms of the User shall not be recognised unless expressly agreed in writing.

These GTC apply to all natural persons who use TalentHub for the purpose of searching for, viewing, or applying to job opportunities in the aviation industry.

2. Description of Services

TalentHub is a specialised aviation job marketplace that aggregates employment opportunities and connects candidates with employers across the aviation sector. The Platform provides the following core services free of charge to candidates:

• Searching and browsing aviation job listings
• Creating and managing a candidate profile
• Uploading and storing CVs/resumes for applications
• Applying to job postings directly through the Platform
• Receiving personalised job recommendations via AeroAI
• Saving job listings for later review

Job listings on the Platform are categorised into three types:

AeroSelect does not guarantee the accuracy, completeness, or timeliness of any job listing, particularly for External Jobs sourced from third parties.

The TalentHub services described above are provided free of charge.

3. Registration and User Account

To access certain features of the Platform (e.g., applying to jobs, saving listings, managing a profile), you must create a user account. Registration requires:

• A valid email address
• A secure password meeting our minimum requirements
• Confirmation that you are at least 18 years of age

You are responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is your responsibility. You must notify AeroSelect immediately of any unauthorised use of your account.

You warrant that all information provided during registration and throughout your use of the Platform is truthful, accurate, and up to date. AeroSelect reserves the right to suspend or terminate accounts that contain materially false or misleading information.

Each natural person may maintain only one active account. AeroSelect reserves the right to merge or remove duplicate accounts.

4. Permitted Use and Restrictions

The Platform is provided exclusively for personal, non-commercial use related to job searching and career development in the aviation industry. The following activities are expressly prohibited:

• Using the Platform for any commercial purpose, including but not limited to recruiting, headhunting, or lead generation, without a separate B2B agreement
• Automated access, scraping, crawling, or data extraction of any kind, whether through bots, scripts, browser extensions, or other automated means
• Reproducing, distributing, or publicly displaying any content from the Platform without prior written consent
• Uploading malicious code, viruses, or any content designed to disrupt Platform operations
• Impersonating another person or entity, or misrepresenting your affiliation with any person or entity
• Attempting to circumvent any security measures, access controls, or rate limits implemented on the Platform
• Using the Platform in any manner that violates applicable laws or regulations

AeroSelect reserves the right to suspend or terminate access for any User who violates these restrictions, without prior notice and without liability.

5. Platform Changes and Availability

AeroSelect strives to maintain continuous Platform availability but does not guarantee uninterrupted or error-free access. We reserve the right to:

• Modify, update, or discontinue any feature or service at any time
• Perform scheduled and unscheduled maintenance that may temporarily affect availability
• Restrict access to certain features or regions for operational or legal reasons

AeroSelect shall not be liable for any loss or inconvenience arising from Platform downtime, modifications, or discontinuation of services.

6. Intellectual Property and Content

All intellectual property rights in the Platform,including but not limited to its design, source code, algorithms, branding, logos, text, and graphics,are and remain the exclusive property of AeroSelect UG or its licensors.

By uploading content to the Platform (e.g., CVs, profile information, cover letters), you grant AeroSelect a non-exclusive, worldwide, royalty-free licence to store, process, and display such content solely for the purpose of providing and improving the Platform services. This licence terminates upon deletion of your account, subject to any legal retention obligations.

You retain full ownership of all content you upload. AeroSelect will not sell, sublicence, or share your content with third parties except as necessary to provide the services described herein or as required by law.

7. Data Protection

AeroSelect processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and applicable German data protection laws (BDSG).

Full details regarding the collection, processing, storage, and your rights concerning personal data are set out in our separate Privacy Policy, available at aeroselect.io/legal/privacy.

By using the Platform, you acknowledge that you have read and understood our Privacy Policy. Where processing is based on consent, you may withdraw such consent at any time without affecting the lawfulness of prior processing.

8. Limitation of Liability

AeroSelect provides the Platform on an ‘as is’ and ‘as available’ basis. To the maximum extent permitted by applicable law:

• AeroSelect is liable without limitation for damages arising from injury to life, body or health, for intentional misconduct (Vorsatz) and gross negligence (grobe Fahrlässigkeit), and under mandatory statutory provisions such as the German Product Liability Act (Produkthaftungsgesetz)
• For damages caused by slight negligence (leichte Fahrlässigkeit), AeroSelect is liable only where a material contractual obligation (Kardinalpflicht) is breached, i.e. an obligation whose fulfilment makes the proper performance of the contract possible at all and on whose observance you may regularly rely. In such cases liability is limited to the typically foreseeable damage
• Any liability going beyond the above is excluded. In particular, AeroSelect is not liable for the content, accuracy, or legality of job listings, particularly External Jobs sourced from third parties, and is not a party to any employment relationship arising from use of the Platform; it assumes no responsibility for hiring decisions, interview outcomes, or employment terms

Your statutory rights as a consumer, in particular your warranty rights, remain unaffected by this Section.

9. Indemnification

You agree to indemnify, defend, and hold harmless AeroSelect, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform in violation of these GTC
• Your violation of any applicable law or regulation
• Any content you upload or submit to the Platform
• Your infringement of any third-party intellectual property or other rights

10. Termination

You may terminate your account at any time by using the account deletion function in your dashboard settings or by contacting us at [email protected] .

AeroSelect may terminate or suspend your account at any time, with or without cause, including but not limited to:

• Violation of these GTC
• Suspected fraudulent, abusive, or illegal activity
• Extended inactivity (12+ months with no login)
• Discontinuation of the Platform or relevant services

Upon termination, your right to access the Platform ceases immediately. AeroSelect may retain certain data as required by law or legitimate business interests, as described in our Privacy Policy. Sections that by their nature should survive termination (including Sections 6, 8, 9, and 11) shall remain in effect.

11. Governing Law and Jurisdiction

These GTC shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC shall be Berlin, Germany, to the extent permitted by law.

For consumers habitually resident in the EU, mandatory consumer protection provisions of the country of residence shall apply where they provide a higher level of protection than German law.

AeroSelect is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of § 36 VSBG.

12. Final Provisions

AeroSelect reserves the right to amend these GTC at any time. Material changes will be communicated to registered Users via email or prominent notice on the Platform at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the amended terms.

Should any provision of these GTC be or become invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original.

These GTC, together with the Privacy Policy and any other referenced documents, constitute the entire agreement between you and AeroSelect regarding your use of the Platform.

No waiver of any provision of these GTC shall be deemed a further or continuing waiver of such provision or any other provision.
